Can I bring my service dog to school with me?

There is much confusion about service dogs in schools. While parts of the school, public areas (such as room gym during a basketball game public) are covered and are considered public places service dogs must be generally admitted, classrooms while class is in session are not covered by the ADA, but the IDEA. The reason is the length of the interaction between members of the public, say, a grocery store, compared to a class. At a grocery store, someone with an allergy or afraid to face what for an hour or two, but in a school, they must cope for several hours each day. A child with allergies may be impaired by drug cons allergies to the effect that the child's abilities to receive free public education. So things must be balanced. That means compromise in May. There was a recent case where a teen with a dog because it continued the hearing was denied access his school with his dog. The court held that the school had the right to deny access because 1) his parents do not pass not through the appropriate channels (ask permission and through the phase of compromise), 2) the school had a right to evaluate his need for the dog service compared with the needs of other students. He lost his case. So yes, schools can indeed deny access to service dogs belonging to students. This is not what most people want to hear, but it's true. The way to get access to a school with a service dog is to have the dog on your IEP (Individual Education Plan) as required by the IDEA (Individuals with Disabilities Education Act). Your parents and school administrators to sit down and develop a plan to better meet your educational needs. Here you negotiate for the service dog. Please note that emotional support animals are not service animals. Even if a person with an emotional support animal would otherwise be entitled to retain the animal in "no pets" housing or to flee with him into the cab with them, they have no right to take their emotional support animals in public housing as a service dog. This is because three different laws, the FHAA for housing, for ACAA theft and ADA access to the public are involved and each sees different emotional support animals. Here is the statement from the U.S. Department of Justice on emotional support animals: "The Department is proposing new regulatory text in ยง 35,104 to formalize its position on emotional support or comfort animals, which is that''[a] nimals whose sole function is to provide emotional support, comfort, therapy, companionship, therapeutic benefits, or promote the emotional well-being are not service animals.''- http://www.ada.gov/NPRM2008/t2NPRM_federalreg.pdf If you have a disability that almost – limits your ability to balance on your own (more than being drunk sometimes) and it is specially trained to perform one or more tasks to help you balance, it could be considered a dog for assistance under both the ADA and IDEA. However, the school has the right to negotiate for a different accommodation, like a walker, if she wants to fulfill your needs assistance equilibrium and another student needs to be off drugs against allergies so they can receive an education too.
